Terms of Service

These terms govern the use of Custivo — the 3D product visualization, augmented reality, virtual try-on and product customization platform available at custivo.com and through e-commerce platform app stores (such as Shopify and ikas). By creating an account or installing the app you agree to these terms on behalf of your business.

The service

Custivo lets merchants create interactive 3D product experiences and embed them into their online stores. Features, limits and prices per plan are described on the pricing page and in the app listing. We continuously improve the service and may add, change or retire features; when a change materially reduces functionality you rely on, we will give reasonable notice.

Accounts

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for the actions of team members you invite. You must be legally able to enter into this agreement for your business.

Subscriptions, trials and billing

• Paid plans are billed in advance on a monthly or annual cycle, through iyzico or — for the Shopify embedded app — through Shopify's billing system on your Shopify invoice.
• New accounts may receive a free trial; when the trial ends the selected plan is charged unless you cancel first.
• You can cancel at any time; the subscription remains active until the end of the paid period. Fees already paid are non-refundable except where required by law.
• Plan prices may change; changes take effect at your next renewal after notice.

Your content

3D models, images and other content you upload remain yours. You grant us the license needed to host, process, display and deliver that content to your storefront and your customers. You are responsible for having the rights to the content you upload and for the products you sell; do not upload unlawful content or content that infringes third-party rights.

Acceptable use

You may not misuse the service — including attempting unauthorized access, disrupting the service, reselling it without authorization, using it to distribute malware, or using it in violation of applicable laws or platform (e.g. Shopify) terms.

Privacy

Our processing of personal data is described in the Privacy Policy. Where we process store visitor data on your behalf, we act as your processor and you remain responsible for providing legally required notices to your customers.

Disclaimers and liability

The service is provided "as is". To the maximum extent permitted by law, we disclaim implied warranties and our total liability arising out of the service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect or consequential damages, or for loss of profits, revenue or data.

Termination

You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination your embedded experiences stop being served; data deletion follows the retention rules in the Privacy Policy.

General

These terms are governed by the laws of the Republic of Türkiye, and disputes are subject to the courts of Istanbul. If a provision is found unenforceable, the rest remains in effect. We may update these terms; material changes will be announced on this page before they take effect. Questions: hello@custivo.com.
